| 内容記述 | The revised Brain death and Organ Transplant Law of Japan (August 2009) left us with four great questions :(1) Defining death ;(2) Presumed Consent(opt-out) mechanism. Since the system of the consent to organ donation was greatly changed into opting-out from opting-in by this law, in this paper, we are going to put emphasis on a research on the method of the consent to the supply of organs. In this respect France has long and instructive experiences in the organ transplantation. The Caillavet-Bioethics Laws, its medical practices and the reexamination works of Lois de Bioethiques (1976-1994-2008)are essential for our comparative research in particular. | |||||
