| 内容記述 | This paper reviews the judgment of the Supreme Court dated December 2,2010. On this case, the plaintiff’s fishes on which real subrogation based preferential rights over movables had set, died on account of red tide and the plaintiff received damage insurance. The plaintiff claimed that the security interest has no effect on insurance. The Supreme Court described that “Real subrogation based preferential rights over movables is effective on damage insurance. But, the mortgagee can not exercise that right as long as mortgagor continues normal business”. This paper reveals the meaning and positioning of this decision, taking into account the common belief, other popular theories, and other decisions. | |||||
