| 内容記述 | In our society, the movements of gang exclusion are increasingly active day by day. In the banking circles also, many banks add“gang exclusion clauses”to deposit contracts and do cancel the contracts with gangs. The Fukuoka District Court also accepted the conclusion in this case. There is no objection to this conclusion. But the suitability of reasoning is another story. In this paper, the author investigate the reasoning of this case, taking into account related cases and theories,newest civil code revision about “Standard-form Contract”,and the latest trends of gang exclusion movement in society. | |||||
