The legal basis of the claim was default (Article 415 Civil Code) and illegal conduct (Article 709). This case includes many important issues related to “negligence”. The judgment (dated December 14,2009) partly admitted the claim for the following reason (1)the defendant violated the duty to provide a proper market system, (2)the defendant bored the duty to stop the deal artificially. But I have different opinions,as especially for “certification methods of gross negligence”.
